The services offered by this website and WAP Site ("the site") are provided to you ("the user") by Bopelo ("the company", "we")

The site is a social networking service that allows you to set up a public profile, to exchange messages with other users, and to post content such as blogs and pictures to public and private areas of the site.

You must be 18 years or older to use the site and have the bill payers permission.

By using this site you warrant that you accept and agree to these terms and conditions.

Handset compatibility

Any handset with an internet connection and web browser is compatible with the site. If you can read these terms or view the join page then your handset is compatible.

Disclaimer

The site is provided on an "as is" and "as available" basis. The company uses its best efforts to maintain the quality of the site, but makes no warranty that the site will meet your requirements, be uninterrupted, complete, timely, secure or error free.

You must provide and are responsible for all equipment necessary to access the site. This equipment includes a device such as a cellphone, tablet, laptop, or PC that has a working internet connection provided by your cellular company or internet service provider and that has a working web browser. The company is not responsible for problems connecting to the site due to problems with your internet connection or equipment.

The company reserves the right to suspend or cancel the site at any time at the sole discretion of the company. The company further reserves the right to add or remove features at any time. The company is not responsible for any loss or damage suffered as a result of these actions.

The company cannot guarantee the accuracy of any information posted to the site by other users. The company is not responsible for any loss or damage suffered as a result of your reliance on such information.

The site may contain links to websites operated by parties other than the company. The appearance of these links does not imply any endorsement of these websites by the company. You agree that the company shall not be held responsible for the legality, accuracy or inappropriate nature of any of these websites, nor for the policies of these websites, nor for any loss or damages suffered as a result of your use of these websites.

The company is not responsible for the use or misuse by other users of any personal information that you disclose to other users.

In the event that you have a claim or action against another user arising from that user's use of the site, you agree to pursue such claim or action independently of and without any demands to the company and you release the company from all claims, liability and damages arising from or in any way connected to the claim or action.

Each user is solely responsible for the information they enter on their profile, the content they post to the site, and the content of the messages they send to other users.

Indemnity

You agree to indemnify and hold harmless the company, its officers, directors, employees, agents, affiliates, partner sites and third parties, from any loss, claim or damage, including reasonable attorney's fees, arising out of or resulting from your use of the site.

Acceptable Use Policy

You agree not to use the site in any way (including to transmit any content) that is contrary to any applicable law or regulation or these terms, or is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libellous, invasive of privacy, hateful, or racially, ethnically or in any way otherwise objectionable.

You agree not to use the site to infringe the privacy rights, property rights, or any other rights of any person.

You agree not to use the site to offer pictures or videos in exchange for airtime, or for sending unsolicited marketing messages, or for soliciting airtime from other users.

You agree not to use the service to:

(i) intentionally engage in illegal conduct,

(ii) knowingly create, store or disseminate any illegal content

(iii) to knowingly infringe copyright,

(iv) knowingly infringe any intellectual property rights, or

(v) send spam or promote the sending of spam.

The company has the right to suspend or terminate the services of any customer who does not comply with these terms and conditions or any other related contractual obligations.

The company has the right to take down any content (hosted as part of the service) that it considers illegal or for which it has received a take-down notice.

The company reserves the right, but has no obligation, to edit or remove any content posted to the site that it deems to be inappropriate, offensive or in violation of these terms.

The company reserves the right, but has no obligation, to restrict your access to parts of the site if it deems that you have posted something inappropriate, offensive or in violation of these terms.

You are responsible for your interactions with other users. The company reserves the right, but has no obligation, to monitor disputes between you and other users.

The company reserves the right, but has no obligation, to restrict your access to parts of the site if it deems that you are using the flag link maliciously or falsely.

Cost of using the site

Use of the site incurs a subscription cost of R1.50 / day. Your regular data charges apply. You must obtain the bill payer's permission to use the site.

In the advent of a billing error, if the error occurred as a direct result of an error made by the company then the billing will be refundable by the company.

Credits

Credits have no value other than their use on this site and cannot be transferred to any other site or exchanged for cash.

Virtual Gifts

The gifts that you send and receive on the site are virtual and have no monetary value on or off the site.

Cancellation

You can cancel at any time by using the My Profile > Cancel link provided on the site, or by following the instructions in the welcome message sent to your phone when you joined, or by sending an SMS with the words STOP JAMBLE to 31021.

All membership fees paid up until the time of cancellation are non-refundable.

The company reserves the right, but has no obligation, to cancel your use of the site if your payments are not up to date or if you are in breach of these terms.

Online safety

Always remember that people on the internet may not be who they say they are. Do not assume that that information entered on this site by other users is correct or truthful.

There are risks associated with giving out personal information such as your phone number, residential address, work address or in agreeing to meet anyone that you have met online.

Never give out personal details such as your phone number or address unless you feel comfortable to do so. If you agree to meet with anyone offline then you should always do so in a public place and make sure that a friend or family member knows exactly where you are.

It is possible that other users may post offensive or obscene materials on the site and that you may be involuntarily exposed to such materials. If this happens please report it immediately.

Promotional messages

The company may send you promotional messages from time to time with details of closely related services.

If you cancel your profile and choose not to remove your details permanently then the company may send you promotional messages for up to 3 months that relate directly to this service and that may be of interest to you.

You can stop these messages by using the My Settings > Privacy Settings menu item, or by using the opt out link in any of the messages.

Complaints procedure

If you encounter content added by another user that violates these terms then please use the flag link to report it. The company cannot accept emails or other messages sent to the company containing screenshots or a "copy paste" of content since these are easy to fake or partially alter. The company cannot enter into a correspondence with users regarding the decisions reached for flags.

Membership of self-regulatory or accreditation bodies

The company is a member of WASPA and is bound by the WASPA Code of Conduct. Customers have the right to approach WASPA to lodge a complaint in accordance with the WASPA complaints procedure. The company may be required to share information relating to a service or a customer with WASPA for the purpose of resolving a complaint. WASPA web site: www.waspa.org.za

Jurisdiction

These terms and conditions, their validity, existence or termination, or any other disputes arising in relation to these terms and conditions shall be governed and/or determined in accordance with the law of the British Virgin Islands.

Whole agreement

These terms and conditions constitute the entire agreement between you and the company. Neither you nor the company shall be bound by any express, tacit or implied representation, warranty, promise or the like not recorded herein.

The company is entitled to cede, assign and delegate all or any of its rights and obligations in terms of these terms and conditions to any third party.

Severability

If any provision in these terms and conditions is invalid or unenforceable under applicable law, such provision will be inapplicable, but the remaining provisions of this agreement will continue in full force and effect.
